Dear President Obama

Vanity | 11/14/12 | Veritas2002

Dear President Obama:

I'm planning to move my family and extended family into Mexico for my health, and I would like to ask you to assist me.
We're planning to simply walk across the border from the U.S. Into Mexico, and we'll need your help to make a few arrangements.
We plan to skip all the legal stuff like visas, passports, immigration quotas and laws.
I'm sure they handle those things the same way you do here. So, would you mind telling your buddy, President Calderon, that I'm on my way over?
Please let him know that I will be expecting the following:

1. Free medical care for my entire family.
2. English-speaking government bureaucrats for all services I might need, whether I use them or not.
3. Please print all Mexican government forms in English.
4. I want my grandkids to be taught Spanish by English-speaking (bi-lingual) teachers.
5. Tell their schools they need to include classes on American culture and history.
6. I want my grandkids to see the American flag on one of the flag poles at their school.
7. Please plan to feed my grandkids at school for both breakfast and lunch.
8. I will need a local Mexican driver's license so I can get easy access to government services.
9. I do plan to get a car and drive in Mexico, but, I don't plan to purchase car insurance, and I probably won't make any special effort to learn local traffic laws.
10. In case one of the Mexican police officers does not get the memo from their president to leave me alone, please be sure that every patrol car has at least one English-speaking officer.
11. I plan to fly the U.S. Flag from my house top, put U S. Flag decals on my car, and have a gigantic celebration on July 4th. I do not want any complaints or negative comments from the locals.
12. I would also like to have a nice job without paying any taxes, or have any labor or tax laws enforced on any business I may start.
13. Please have the president tell all the Mexican people to be extremely nice and never say critical things about me or my family, or about the strain we might place on their economy.
14. I want to receive free food stamps.
15. Naturally, I'll expect free rent subsidies.
16. I'll need Income tax credits so although I don't pay Mexican Taxes, I'll receive money from the government.
17. Please arrange it so that the Mexican Gov't pays $4,500 to help me buy a new car.
18. Oh yes, I almost forgot, please enroll me free into the Mexican Social Security program so that I'll get a monthly income in retirement.
I know this is an easy request because you already do all these things for all his people who walk over to the U.S. from Mexico.
Adios Americanos

Obama says tax hike will have to come first in "fiscal cliff" deal!

reuters ^ | 11/14/2012 | Andy Sullivan

President Barack Obama said on Wednesday that Republicans would have to agree to raise taxes on the wealthy as the first step in a budget deal that would prevent a dysfunctional Washington from pushing the economy into recession.
In his first news conference since winning re-election last week, Obama said he would be open to considering Republican priorities like entitlement reform and a tax-code overhaul as part of a broad-based deal to get the nation's finances on a sustainable course.
But Obama said Republicans in Congress would first have to agree to his top priority in the complex negotiations aimed at preventing a $600 billion combination of tax increases and spending cuts known as the "fiscal cliff" that could halt the weak economic recovery at the beginning of next year.
"What I'm not going to do is to extend further a tax cut for folks who don't need it," Obama said, shortly before meeting with a dozen business leaders who are pushing policymakers to reach a deal.

A well thought out response by a man pointing out what Obamacare truly is! ^

Free Home for any who will take it!

I was in my neighborhood restaurant this morning and was seated behind a group of jubilant individuals celebrating the successful passing of the recent health care bill. I could not finish my breakfast. This is what ensued:

They were a diverse group of several races and both sexes. I heard the young man exclaim, “Isn’t Obama like Jesus Christ? I mean, after all, he is healing the sick.” The young woman enthusiastically proclaimed, “Yeah, and he does it for free. I cannot believe anyone would think that a free market would work for health care. Another said, ‘The stupid Republicans want us all to starve to death so they can inherit all of the power. Obama should be made a Saint for what he did for those of us less fortunate.” At this, I had more than enough.

I arose from my seat, mustering all the restraint I could find, and approached their table. “Please excuse me; may I impose upon you for one moment?” They smiled and welcomed me to the conversation. I stood at the end of their table, smiled as best I could and began an experiment.

“I would like to give one of you my house. It will cost you no money and I will pay all of the expenses and taxes for as long as you live there. Anyone interested?” They looked at each other in astonishment. “Why would you do something like that?” asked a young man, “There isn’t anything for free in this world.” They began to laugh at me, as they did not realize this man had just made my point. “I am serious, I will give you my house for free, no money what so ever. Anyone interested?” In unison, a resounding “Hell Yeah” fills the room.

“Since there are too many of you, I will have to make a choice as to who receives this money-free bargain.” I noticed an elderly couple was paying attention to the spectacle unfolding before their eyes, the old man shaking his head in apparent disgust. “I tell you what; I will give it to the one of you most willing to obey my rules.” Again, they looked at one another, an expression of bewilderment on their faces. The perky young woman asked, “What are the rules?” I smiled and said, “I don’t know. I have not yet defined them. However, it is a free home that I offer you.” They giggled amongst themselves, the youngest of which said, “What an old coot. He must be crazy to give away his home. Go take your meds, old man.” I smiled and leaned into the table a bit further. “I am serious, this is a legitimate offer.” They gaped at me for a moment.

“I’ll take it you old fool. Where are the keys?” boasted the youngest among them. “Then I presume you accept ALL of my terms then?” I asked.. The elderly couple seemed amused and entertained as they watched from the privacy of their table. “Oh hell yeah! Where do I sign up?” I took a napkin and wrote, “I give this man my home, without the burden of financial obligation, so long as he accepts and abides by the terms that I shall set forth upon consummation of this transaction.” I signed it and handed it to the young man who eagerly scratched out his signature. “Where are the keys to my new house?” he asked in a mocking tone of voice. All eyes were upon us as I stepped back from the table, pulling the keys from pocket and dangling them before the excited new homeowner.

“Now that we have entered into this binding contract, witnessed by all of your friends, I have decided upon the conditions you are obligated to adhere from this point forward. You may only live in the house for one hour a day. You will not use anything inside of the home. You will obey me without question or resistance. I expect complete loyalty and admiration for this gift I bestow upon you. You will accept my commands and wishes with enthusiasm, no matter the nature. Your morals and principles shall be as mine. You will vote as I do, think as I do and do it with blind faith. These are my terms. Here are your keys.”

I reached the keys forward and the young man looked at me dumbfounded.

“Are you out of your mind? Who would ever agree to those ridiculous terms?” the young man appeared irritated. “You did when you signed this contract before reading it, understanding it and with the full knowledge that I would provide my conditions only after you committed to the agreement.” Was all I said. The elderly man chuckled as his wife tried to restrain him. I was looking at a now silenced and bewildered group of people. “You can shove that stupid deal up you’re a** old man, I want no part of it” exclaimed the now infuriated young man. “You have committed to the contract, as witnessed by all of your friends; you cannot get out of the deal unless I agree to it. I do not intend to let you free now that I have you ensnared. I am the power you agreed to. I am the one you blindly and without thought chose to enslave yourself to. In short, I am your Master.” At this, the table of celebrating individuals became a unified group against the unfairness of the deal.

After a few moments of unrepeatable comments and slurs, I revealed my true intent. “What I did to you is what this administration and congress did to you with the health care legislation. I easily suckered you in and then revealed the real cost of the bargain. Your folly was in the belief that you can have something you did not earn; that you are entitled to that which you did not earn; that you willingly allowed someone else to think for you. Your failure to research, study and inform yourself permitted reason to escape you. You have entered into a trap from which you cannot flee. Your only chance of freedom is if your new Master gives it to you. A freedom that is given can also be taken away; therefore, it is not freedom.” With that, I tore up the napkin and placed it before the astonished young man. “This is the nature of your new health care legislation.”

I turned away to leave these few in thought and contemplation and was surprised by applause. The elderly gentleman, who was clearly entertained, shook my hand enthusiastically and said, “Thank you Sir, these kids don’t understand Liberty these days.” He refused to allow me to pay my bill as he said, “You earned this one, it is an honor to pickup the tab.” I shook his hand in thanks, leaving the restaurant somewhat humbled, and sensing a glimmer of hope for my beloved country.

The Apostle Barack?

Green Room ^ | 11-14-2012 | Ed Morrissey

This is not, PJM’s Myra Adams warns us, a joke — or at least not an intentional joke. Nor is this offered in an ironic sense, as in how the media has portrayed Barack Obama. This epistle comes from a phys-ed professor at Florida A&M, who claims God told her that Barack Obama is the fifth Beatle, er, thirteenth Apostle:
Still think this is some kind of put-on? Take a look at the Amazon page:
(snip) Then, as I began to contemplate ways to assist Barack in his 2012 re-election bid something miraculous happened. I felt God’s (His) Spirit beckoning me in my dreams at night. Listening, cautiously, I learned that Jesus walked the earth to create a more civilized society, Martin (Luther King) walked the earth to create a more justified society, but, Apostle Barack, the name he was called in my dreams, would walk the earth to create a more equalized society ........

Obama Defending Susan Rice's Phony Benghazi Story Like A 'Dramatic' Movie Moment ^ | November 14, 2012 | Kyle Drennen

Following President Obama's Wednesday afternoon press conference, NBC Nightly News anchor Brian Williams continued his longtime obsession with the liberal fantasy film The American President and his eagerness to compare Obama to Michael Douglas's fictional presidential character: "...the President today almost conjuring the wording of Aaron Sorkin from the movie American President, as will be pointed out all day, really decided to throw down." [Listen to the audio or watch the video after the jump]

Referring to Obama's indignation at critics of U.N. Ambassador Susan Rice, who made false statements about the terrorist attack in Libya, chief foreign affairs correspondent Andrea Mitchell gushed: "This was President Andrew Shepherd really coming through in the East Room of the White House. Because this was President Obama saying, 'If you want to pick a fight with my U.N. ambassador, and blame her for something that was not her responsibility on Benghazi, then you come after me'....It was dramatic. He is angry."
NBC: Obama Defending Susan Rice's Phony Benghazi Story Like A 'Dramatic' Movie Moment
Mitchell continued: "I know from talking to the White House that they are very angry, they feel Susan Rice is being unfairly blamed, that she was working off of talking points from the intelligence community....[that] she should not be blamed for what she said about Benghazi."
Neither Williams nor Mitchell bothered to detail the mountain of evidence showing Rice's statements about the attack, on all five September 15 Sunday shows, to be patently untrue.
Here is a transcript of the exchange that occurred during November 14 post-press conference coverage:

2:27PM ET (...)

BRIAN WILLIAMS: And Andrea, there couldn't be more going on right now. There was talk of the fiscal cliff. We have no CIA director. Benghazi's still around. The Israelis took out the head of Hamas today. And then, John McCain said that if the President puts up his U.N. ambassador, Susan Rice, to replace Hillary Clinton as secretary of state, she will be blocked, they'll do everything in their power. That's where the President today almost conjuring the wording of Aaron Sorkin from the movie American President, as will be pointed out all day, really decided to throw down.
ANDREA MITCHELL: This was President Andrew Shepherd really coming through in the East Room of the White House. Because this was President Obama saying, "If you want to pick a fight with my U.N. ambassador, and blame her for something that was not her responsibility on Benghazi, then you come after me, John McCain and Lindsey Graham. Don't come after Susan Rice." It was dramatic. He is angry. I know from talking to the White House that they are very angry, they feel Susan Rice is being unfairly blamed, that she was working off of talking points from the intelligence community. And that in her Sunday appearance on Meet the Press, she should not be blamed for what she said about Benghazi.

Scalia vs. Thomas Jefferson on secession: Will nation 'submit to government without limits'?

WND ^ | November 14, 2012 | Bob Unruh

Contemporary opinions, including those of Supreme Court Justice Antonin Scalia, say the idea of a state’s right to secede died with the hundreds of thousands of bloodied victims of the Civil War, and that the sentiment behind the dozens of petitions on a White House website seeking permission for most of the 50 individual governments to leave the union will be fruitless.

But historians would note that even Thomas Jefferson, a “pole star among political philosophers because he based his politics on the eternal, self-evidence, fundamental truths that all men are created free and equal and that they are endowed by their Creator with certain inherent and unalienable rights, among which are life, liberty and the pursuit of happiness,” might be remembered for his opinion about states leaving the U.S.
It was in a letter to William B. Giles on Dec. 26, 1825, when Jefferson, who already had seen the fight over the states’ separation from England, the rise of a new nation and the tribulations it faced in its first decades, that he addressed the issue.
In a letter marked “not intended for the public eye,” he wrote that states “should separate from our companions only when the sole alternatives left, are the dissolution of our Union with them, or submission to a government without limitation of powers.”
He continued, “Between these two evils, when we must make a choice, there can be no hesitation.”
His letter, posted online at, sheds new light on the arguments being raised on the Obama administration’s online petition site, where dozens of petitions are seeking permission for virtually all of the states to leave the union.
The Blaze reported on a 2006 letter purporting to be from Supreme Court Justice Antonin Scalia that said, “There is no right to secede.

Silencing General David Petraeus

The Washington Times ^ | November 14, 2012 | Andrew P. Napolitano

Obama administration’s dirty hands

The evidence that Gen. David H. Petraeus, formerly the commander of U.S. troops in Afghanistan and Iraq, the author of the current Army field manual, Princeton Ph.D. and, until last week, the director of the Central Intelligence Agency, was forced to resign from the CIA to silence him is far stronger than is the version of events that the Obama administration has given us.
The government would have us believe that because the FBI confronted Gen. Petraeus with his emails showing a pattern of inappropriate personal private behavior, he voluntarily departed his job as the country’s chief spy to avoid embarrassment. The government would also have us believe that the existence of the general’s relationship with Paula Broadwell, an unknown military scholar who wrote a book about him last year, was recently and inadvertently discovered by the FBI while it was conducting an investigation into an alleged threat made by Mrs. Broadwell to another woman. The government would as well have us believe that the president learned of all this at 5 p.m. on Election Day.
We now know that the existence of a personal relationship between Mrs. Broadwell and Gen. Petraeus had been suspected and whispered about by his senior-level colleagues and by his personal staff in the military, who worried that it might become publicly known, since before the time that he came to run the CIA.
We also know that when he was nominated to run the CIA, that nomination was preceded by a two-month FBI-conducted background check that likely would have revealed the existence of his relationship with Mrs. Broadwell. The FBI agents conducting that background check surely would have seen his visitor logs while he commanded our troops...

Obama's Smug America

American Spectator ^ | 11.14.12 | George Neumayr

It is always going "forward" no matter how much it declines.

By every objective measure, America is in decline. But liberals insist that it is moving "forward." The modern philosophy of progress is Darwinian, holding that the latest development, whether of a country or a species, is always the best one. Mutations are assumed to be perfective, not destructive.

Obama is the one "we have been waiting for," chanted his followers in 2008. They identified him as the agent of the final phase in liberalism's revolution. In 2012, Obama drew upon this revolutionary hope again, coining "forward" as his campaign slogan. The rhetoric was slightly more subdued -- he toned down the talk of "fundamentally transforming" America -- but it still rested on the same revolutionary promise. No coherent criterion defines Obama's notion of revolutionary progress. It is whatever liberalism deems good at the moment. This results in trendy liberal causes clanking up a bit against each other: a progressive, for example, can be at once anti-smoking and pro-marijuana. Second-hand smoke is deadly; but drug legalization poses no harms. Celebrities like comedian Bill Maher burbled over the passage of marijuana legalization bills as part of the new enlightenment under Obama. So apparently the Democrats can be the party of "preventative" health care, anti-obesity campaigns, and recreational drug use all at the same time.
"It is dying but it laughs," said the Romans of their collapsing empire. The chortling of the Bill Mahers last week deserves a similar line.

Obamacare has more chinks in its armor than a turtle without a shell

CCHC ^ | 11-14-12 | twila brase

Obamacare has more chinks in its armor than a turtle without a shell. As a result, state governors and legislators can inflict great damage. The following amazing chink was discussed by a Goldwater Institute attorney during a Tennessee-based webinar on Monday . It's only 10 lines long in the 950-page version of the law:

"No individual, company, business, nonprofit entity, or health insurance issuer offering group or individual health insurance coverage shall be required to participate in any Federal health insurance program created under this Act (or any amendments made by this Act), or in any Federal health insurance program expanded by this Act (or any such amendment), and there shall be no penalty or fine imposed upon any such issuer for choosing not to participate in such programs."

Let that sink in. No one is required to participate.

Can We Replace John Boehner With Paul Ryan? ^ | November 13, 2012 | Erick Erickson

John Boehner has been willing to throw his conference under the bus repeatedly. We know from the Bob Woodward book that he was willing to raise taxes. We know he cut a deal with Barack Obama without consulting the rest of his conference. We know it blew up in his face.

We know he now doesn’t even want to fight Obamacare, calling it the “law of the land.” We know he only walked back that statement because of the outrage that ensued.

We know he wants to start putting moderates into leadership positions like Cathy McMorris Rodgers instead of Tom Price. We know he is demanding conservatives “get in line”.

House Republicans are being badly served by John Boehner.

Obama to open ‘fiscal cliff’ talks with call for $1.6 Trillion in new revenues!

The Hill ^ | 11/14/2012 | Daniel Strauss

President Obama is taking a tough opening stance in talks over deficit reduction, pushing Republicans to accept a plan that calls for $1.6 trillion in new tax revenue over the next ten years, according to reports.

The figure is double the $800 billion last discussed by the White House and House Speaker Boehner (R-Ohio) during their 2011 negotiations on raising the debt-ceiling limit.

The president’s plan is based on his most recent budget proposal, which sought the $1.6 in new revenues by targeting the wealthy and corporations.

The president and congressional lawmakers are set to meet at the White House on Friday as both sides begin hammering out a deficit-cutting plan that helps the nation move past the “fiscal cliff” of rising tax rates and automatic spending cuts set to take effect in January 2013....

House Republicans on Wednesday were incredulous at the president's opening bid....
On Tuesday the president met privately with a number of union leaders and liberal activists to discuss his plan. In the meeting Obama reportedly promised to make good on his vow to renew low tax rates for the middle class and let them expire for wealthy households.

Holder staying on for second term means more of same for Fast and Furious probe!

Gun Rights Examiner ^ | 13 November, 2012 | David Codrea

Most likely ending speculation Eric Holder started last week when he announced he may not stay on for a second term, the New York Post reported today that the attorney general will remain on the job at the request of the president.

Gun Rights Examiner raised troubling concerns that the floated resignation could remove Holder as a subject for further investigation into Fast and Furious gunwalking, and also raised the alarm that potential replacements being discussed in the press must be vetted with the gun issue being a non-negotiable litmus test. Holder’s reported decision not to resign now means he will still be the top decision-maker responsible for fielding House Committee on Oversight and Government Reform inquiries related to its ongoing investigation.

If the Post report is correct, Holder will stay on knowing he remains under the president’s executive protection. Also to be decided will be his motion that the U.S. District Court has no jurisdiction over the civil contempt of Congress complaint against him, but no matter which way that goes, the case can be dragged on for years via appeals.
“This might leave some to speculate, ‘What does Holder have on Obama?’” Seattle Gun Rights Examiner Dave Workman observed in a report today. “This might be a natural progression from the question people were asking this summer when Obama granted executive privilege protection to the subpoenaed documents: ‘What is Obama trying to hide?’”

How CIA Director David Petraeus’s Emails Were Traced (and How to Protect Yourself)

Lifehacker ^ | Tuesday, November 13, 2012 | Thorin Klosowski

Late last week, CIA director David Petraeus stepped down from his position after an FBI investigation revealed an extramarital affair with his biographer, Paula Broadwell. Curiously, the revelation of the affair came about using location data from Gmail. Here's how the FBI put together the pieces, and how you can keep them from doing the same to you.

How the Affair Was Revealed by Tracing through Gmail

As you'd expect, the timeline of the affair itself is terribly complicated, and to understand the email trace that lead to the outing of the relationship, we do need to vaguely understand what happened with the affair. Here's a very brief summation of the events.

According to the Wall Street Journal, the original red flag that caught the FBI's ear was a series of anonymous, threatening emails sent to Jill Kelley, a Florida woman who organized military social events. The FBI then traced those threatening emails to their origin—probably with an IP address given up by Google—to Paula Broadwell. The FBI then got a warrant to monitor those email addresses, and eventually stumbled upon another email account where Petraeus and Broadwell left drafts of messages for each other:...

WH: Obama 'Does Not Believe That Reducing Deficits and Debt Are Values Unto Themselves'

CNSNews ^

( - Plugging a "truly balanced approach to our fiscal challenges," White House spokesman Jay Carney on Tuesday said President Obama does not view the issue of deficits and debt in a vacuum:

"He does not believe that reducing deficits and debt are values unto themselves. He believes that they are part of an approach that is driven by his number-one priority, which is economic growth and job creation."

Also on Tuesday, the Treasury Department announced a $120-billion deficit for October, the first month of fiscal 2013. That puts the nation on track to its fifth straight trillion-dollar-plus deficit.

One Graph That Shows Which Party Really Looks Like America

Front Page Magazine ^ | November 13, 2012 | Daniel Greenfield

“Why is the Republican Party so white?” is the great whine issuing forth from the fat mouths of a thousand media outlets.

The Republican Party needs to be a party that “looks more like America” is the big lie of the left. So let’s take a look at the racial composition of Americans and the percent of the racial vote that Democrats and Republicans received to see which party really looks more like America.

There’s America in gray. And the Republican Party in red right next to it. And there’s the Democratic Party off to the side looking nothing like America.

In all cases, the Republican vote is closer to the demographics of America than the Democratic vote.

The racial composition of America is 63 percent white. Romney received 59 percent of the white vote with 39 percent left over for Obama.
While the 223.6 million white Americans, who look like America and whom America looks like, were not fully represented by either party; they were most represented by the Republican Party. The Democratic Party really needs to work on its share of the white vote because the Democratic Party no longer looks like America.
White Americans are the majority in 49 of the 50 state and also continue to act as a swing vote, determining presidential elections by shifting one way or another, in contrast to other some racial groups who narrow-mindedly vote as a bloc.

The Republican share of the vote shows inclusiveness picking up the votes of two out of three minority groups at a greater percentage than their representation in the population.

The racial composition of America is 16 percent Hispanic. The Republican Party exceeded the Hispanic share of the population in its representation by picking up 27 percent of the Hispanic vote. The Democrats got 71 percent of their vote, which is impressive, but another reminder that the Democratic Party does not look like America.

Asians make up 5 percent of America. Republicans picked up 26 percent of their vote. Democrats picked up 73 percent of the Asian vote. Again the Republicans picked up a larger share of the Asian vote than the representation of Asians in the population.

Blacks make up 13 percent of the population. Republicans picked up 6 percent of the Black vote. Only among Blacks did Romney pick up a lower share of the vote than their proportion in the American population. And if Romney had not been running against a black candidate, he would have probably matched Bush’s 11 percent of the black vote, which is fairly comparable to the black racial demographics of America.

The Republican share of the vote from 2012 is closest to the demographic picture of America. Two out of three minority groups are overrepresented. And only black people are underrepresented for reasons that have to do with racial pride, not a lack of Republican inclusiveness.

The Republican Party looks like America. The Democratic Party does not. And it is the Democratic Party that needs to work harder to be more representative of America.

Analysis: Why the GOP Should Deal With Immigration (They still wouldn't vote GOP)

ABC ^ | 11/14/2012 | By JORDAN FABIAN

The debate within the Republican Party over whether to make a deal regarding immigration has quickly reached full steam.

In the wake of a crushing defeat in the presidential election, partly fueled by Latino voters, Republican leaders in Congress have indicated they are ready to return to the negotiating table on a comprehensive immigration reform bill, a proposal that's been dead for five years. But some conservative commentators and lawmakers have held up their hands as if to say, not so fast.

Hardline figures such as Iowa Rep. Steve King have outright rejected the idea of an immigration compromise. Other conservatives have made more subtle arguments against compromise on immigration policy.

Writing in The New York Times last weekend, Ross Douthat dismissed Republicans' rush to embrace immigration reform that contains a pathway to citizenship as a "legislative pander" that will not guarantee that Latino voters embrace the GOP. In addition, he argues that a leftward shift on immigration policy could turn off white-working class voters from the Republican Party.

Look Who's Refusing To Compromise To Avoid The Fiscal Cliff

Investor's Business Daily ^ | 11/13/2012 | IBD Staff

Budget Talks: If President Obama wants to get a deficit deal done to avoid the fiscal cliff, his biggest challenge won't be Republicans, but his own hard-core left-wing supporters.

Two days after the election, Obama's favorite economist, Paul Krugman, set the tone for the intransigent left in a column titled: "Let's not make a deal." Boiled down, his advice to Obama was this: Don't give in to any Republican demands, even if doing so would "inflict damage on a still-shaky economy." After all, Obama would be better positioned to "weather any blowback from economic troubles."

Krugman's advice may be disturbingly cold and calculating, but he has plenty of company on the left.

Nov. 13, 2012, Fairfax, VA—Americans for Limited Government President Bill Wilson today urged Governor Rick Snyder not to implement a state-run health insurance exchange under Obamacare.

In his letter, Wilson wrote that the governor “hold[s] the fate of President Obama’s Affordable Care Act, also known as Obamacare, in your hands,” noting that if the exchange is not implemented by Snyder, employers in the state will be protected from the law’s employer mandate.

“Without the cost burdens imposed by the state exchange, your employers will enjoy a significant competitive advantage over their competitors in states which have exchanges,” Wilson wrote.

The letter references a study by the Cato Institute’s Jonathan Adler and Michael Cannon, “Taxation without representation: The illegal IRS rule to expand tax credits under the PPACA.”

In it, Adler and Cannon make the case that “An Internal Revenue Service (IRS) rule purports to extend these tax credits and subsidies to the purchase of health insurance in federal exchanges created in states without exchanges of their own. This rule lacks statutory authority.”

The study explains, “The text, structure, and history of the Act show that tax credits and subsidies are not available in federally run exchanges. The IRS rule is contrary to congressional intent and cannot be justified on other legal grounds.”

By not implementing the exchange, the state would effectively give affected employers the standing to sue against the new IRS rule, Wilson said in a statement.

“It is up to Governor Snyder to at least give employers a chance of fighting against Obamacare. But if the exchange is implemented by the state, they will not have any chance at all,” Wilson concluded.
